Minimum requirements for the location of Border Control Posts (BCPs): consultation analysis

This report provides an analysis of responses to the public consultation on proposals to amend the minimum requirements for the location of a Border Control Post (BCP).


1. Executive summary

The Scottish Government conducted a consultation on proposals to amend the minimum requirements for the location of a Border Control Post (BCP). The consultation was open from 15 December 2025 to 15 January 2026.

Following the closing date, all responses were analysed and considered along with any other available evidence to help the decision making process. Responses are published where there is permission to do so on Citizen Space.

The proposed changes to the legislation were signed on 5 February 2026 and laid in the Scottish Parliament on 9 February 2026. The Rural Affairs and Islands Committee considered the negative instrument— Official Controls (Location of Border Control Posts) (Scotland) Regulations 2026 (SSI 2026/61) 4 March 2026.
