Payments

People who can pay towards their legal aid should still be asked to. The amount depends on the type of legal aid.

A review of legal aid in 2018 said this makes things confusing and unfair. People with the same income may have to pay different amounts.

The new plan has clear and fair rules. There would be 2 decisions:

  • should someone get legal aid
  • how much they should pay.

The new plan says the Board must check limits and payment rules and report this to Scottish Ministers.

This would make sure that payment amounts are easier to understand and fair. It would let the system be flexible and affordable.
