Section 3: Excluded Persons
In order to work in as a ‘social service worker’ in a care service in Scotland, legislation currently dictates that individuals must hold active registration with the SSSC. This is a vital part of Scotland’s ability to regulate our social services workforce and protect those using our care services.
There are, however, some exceptions to this requirement.
There are instances where an individual’s specific role requires them to register with another professional regulator, such as where a care home manager is registered with the Nursing and Midwifery Council. Article 3 of the Regulation of Care (Social Service Workers) (Scotland) Order 2024 therefore lists the bodies a person may be registered with, which excludes them from requiring to hold registration with the SSSC.
There are two updates required to the list of bodies mentioned within the Order. These are:
- Article 3(1)(e) the General Teaching Council for England – this body has now been dissolved.
- Article 3(1)(f) the General Teaching Council for Wales – this body was renamed in 2015 as ‘Education Workforce Council’ as per the Education (Wales) Act 2014
To ensure the Order portrays an accurate and up to date reflection of the relevant bodies, we propose that references made to the ‘General Teaching Council for England’ are removed, and that references to the ‘General Teaching Council for Wales’ are replaced with ‘Education Workforce Council’. We are consulting on this proposal given the statutory duty to consult provided for at section 44(4) of the Regulation of Case (Scotland) Act 2001.
