Who we are

We are the Livestock Products Policy Team and Food and Drink Division of Scottish Government. Our head office is located at Saughton House, Broomhouse Drive, Edinburgh, EH11 3XD.

The Scottish Ministers have made available the Scottish Pig Producers Support Scheme to provide support for Scottish pig producers, following the significant drop in prices being received for pigs. The Scottish Government Division that oversees this fund is the Food and Drink Division which sits within the Agriculture and Rural Economy Directorate.

Lawful basis

The lawful basis under the UK GDPR being relied on to use your personal data is:

Article 6(1)(e) of the UK GDPR is ‘Processing is necessary for a task carried out in the public interest’. The purpose of the scheme is to provide eligible pig producers in Scotland with financial support to help cover losses resulting from the recent downturn in pig prices. The Scottish Ministers have powers under sections 6 of the Agriculture and Rural Communities (Scotland) Act 2024 to provide support.

In relation to publishing an annual statement of all payments over £25,000 in compliance with section 31(3) of the Public Services Reform (Scotland) Act 2010 we will rely on Article 6(1)(c) of UK GDPR that the ‘processing is necessary for compliance with a legal obligation to which the controller is subject’.

Personal data may be processed and disclosed where required to comply with obligations under the Subsidy Control Act 2022, including the publication of certain subsidy awards of £100,000 or more on the Department for Business and Trade's Subsidy Transparency Database. The information published may include the name of the beneficiary, the amount of funding awarded, the date of award and other information required by legislation.

What we do with your personal information

We will use your personal information for the purposes of administering the scheme, including assessing your eligibility and administering payments.

How we keep your personal information secure and how long we keep it for

Your personal data will be kept securely within our corporate records management system.

As with all emergency payments funds, the personal data you provide to us within your application will be retained for one year following the closure of the scheme. This allows for any appeals, reviews, recovery action and other activity to be completed. Payment records may be kept for longer, usually 6 years if they are relevant to the tax that you might have to pay. The Scottish Government holds different types of data for a variety of different reasons; we only keep your personal data for the minimum amount of time necessary.

Who we share your personal information with

For the purpose of audit evaluation, information (including personal data and commercial information) may be shared with other government departments in the UK, and other government agencies and their agents including HMRC.

The Scottish Ministers may disclose information submitted to them for the purposes of the scheme to the Scottish Parliament or the United Kingdom Parliament.

In order to comply with section 31(3) of the Public Services Reform (Scotland) Act 2010, the Scottish Ministers publish an annual statement of all payments over £25,000. In addition, in line with openness and transparency, the Scottish Government publishes a monthly report of all payments over £25,000. The Grantee should note that where a payment is made in excess of £25,000 there will be disclosure (in the form of the name of the payee, the date of the payment, the subject matter and the amount of grant) in both the monthly report and the annual Public Services Reform (Scotland) Act 2010 statement.
