Common Agricultural Policy: beneficiary publication guidance
The guidance outlines the data protection principles and requirements for all parties involved in processing personal data to publish data of Common Agricultural Policy (CAP) scheme beneficiaries on the Scottish web site as already happens at present under the existing UK Scheme .
1. Background
Between 2014 and 2022, the publication of Common Agricultural Policy (CAP) beneficiary data was governed primarily by EU Regulation 1306/2013 articles 111-114 and 908/2014 Articles 57-62, which laid out transparency obligations for Member States[1]. Following the UK's exit from the EU, these regulations became UK’s assimilated law and continue to underpin transparency obligations for CAP-related payments. Additionally, the publication of personal data remains subject to the UK General Data Protection Regulation (UK GDPR), which governs the lawful processing of personal information.
