Legal Framework in which the Adjudicator operates
The SPCA operates under the Tied Pubs (Scotland) Act 2021, which established the Scottish Pubs Code to regulate the relationship between tied pub tenants and pub-owning businesses. The Code ensures fair treatment, transparency, and accountability in these business arrangements.
The Adjudicator is responsible for enforcing compliance with the Code, investigating disputes, and taking enforcement actions, including financial penalties, where necessary. The Adjudicator also provides guidance to both tenants and pub-owning businesses, ensuring that all parties understand their rights and obligations under the Code.
Additionally, the Adjudicator has the authority to arbitrate disputes between tenants and pub-owning businesses, helping to resolve conflicts efficiently and fairly.
