Scottish Court Fees 2026-2027: consultation analysis and Scottish Government response
This paper summarises the responses and states the Scottish Government's response to the consultation on Scottish Court Fees 2027 to 2027.
Consultation
Conclusion
66. The Scottish Government appreciates the range of views provided through this consultation. While perspectives differed on the proposed increases, there was a shared recognition of the need for a fair, sustainable and transparent system of civil court fees. The Scottish Government considered the consultation responses fully before deciding to increase most fees by 3% in each of the next two years. This is below the current rate of inflation.
67. Preparatory work has now begun on a full review of the court fee structure, including the establishment of a Court Fee Working Group. The Group is expected to report in late 2026 or early 2027. A public consultation on its recommendations will follow. A further consultation to consider further changes at that point will follow.
