Scottish Court Fees 2026-2027: Analysis of Consultation and Scottish Government Response

This paper summarises the responses and states the Scottish Government's response to the consultation on Scottish Court Fees 2027-2027.


Conclusion

66. The Scottish Government appreciates the range of views provided through this consultation. While perspectives differed on the proposed increases, there was a shared recognition of the need for a fair, sustainable and transparent system of civil court fees. The Scottish Government considered the consultation responses fully before deciding to increase most fees by 3% in each of the next two years. This is below the current rate of inflation.

67. Preparatory work has now begun on a full review of the court fee structure, including the establishment of a Court Fee Working Group. The Group is expected to report in late 2026 or early 2027. A public consultation on its recommendations will follow. A further consultation to consider further changes at that point will follow.
