Recommendation 5 – Approved Document B Review and Update

Activity since last update

A Scottish Building Regulations: Fire Safety review and Compliance: Call for Evidence (CFE) was opened on 16 January and closed on 10 April 2026.

A total of 57 responses were received. Of these, 51 responses have been published, where respondents granted permission for publication. The published responses are available at: Published responses for Scottish Building Regulations: Fire Safety review and Compliance: Call for Evidence

Procurement activities have been completed, and a contractor has been appointed to undertake the analysis of the CFE responses.

Planned activity

The consultation analysis phase commenced in June 2026, with officials working closely with the appointed contractor to review and analyse the responses received. Subject to the complexity and volume of the responses, the analysis is expected to be completed in Autumn 2026, with publication of the findings following shortly thereafter.

In parallel, officials are progressing arrangements for a Fire Safety Expert Working Group. This includes developing the terms of reference, identifying membership, issuing invitations, preparing the work programme, and seeking the necessary ministerial approvals. The Group will be established to consider both the findings of the Call for Evidence and wider fire safety issues, including matters arising from the Grenfell Tower Inquiry Phase 2 recommendations and the Scottish Government’s response. The Group is expected to be convened and hold its inaugural meeting in mid to late Autumn 2026.

The Scottish Government has liaised with UK Government counterparts regarding ongoing research into testing approaches and methodologies.

Planned activity

The Scottish Government will continue to engage with UK Government counterparts, particularly in relation to reviewing the findings and conclusions of research into testing methodologies. It will also seek representation on any relevant working group established to consider the research outcomes and/or future developments.

Recommendation 12 – BS 9414 Usage Guidance Update

Recommendation 13 - Construction Product Certification Reform

Activity since last update

Construction Product Regulations is a reserved matter and Scotland follows the regime defined for the UK.

A Construction Products Reform Green Paper was published by the UK Government on 25 February 2025 seeking views on proposals for reform by 21 May 2025. Following analysis of the Green Paper responses, a White Paper was published on 25 February 2026 and remained open for views from interested parties until 20 May 2026.

MHCLG is currently analysing feedback on the White Paper consultation and the report will be published in due course.

Planned activity

We will continue to engage with MHCLG on this to hear about next steps when the consultation report is published.

Recommendation 40 - BS 750 Flow Coefficient Amendment

The British Standards Institution (BSI) along with an expert panel have prepared a revised draft to amend BS 750 to include a description of the circumstances under which the flow coefficient to which it refers in paragraph 10.2 is to be measured. The draft was issued for public comment on 13 February and closed 13 April 2026. The publication is scheduled for 16 November 2026.

Planned activity

BSD Fire Team to monitor the outcomes of the progress towards the scheduled publication. This will involve monitoring the BSI and UK Government updates.
