5. End of Analysis

5.1. Conclusion

Digital assets and distributed ledger technology present a significant opportunity for Scotland’s financial sector, technological innovation, and economic growth. To maintain Scotland’s competitiveness and ensure that our legal framework keeps pace, the Scottish Government is considering possible future primary legislation to clarify how digital assets are treated under Scots private law.

The responses to this consultation have demonstrated that there is strong support for clarifying the status of digital assets in Scots law and for achieving this via primary legislation.
