Compulsory Purchase Reform: Consultation Responses Summary

This report provides a summary of the responses to the Scottish Government's 2025 consultation on proposals for reform of compulsory purchase in Scotland. A separate analysis of responses to the consultation questions on compulsory sale and lease orders has also been published.


10. Compulsory Sale and Lease Orders

Questions 106 to 117 of the consultation paper related to compulsory sale orders and compulsory lease orders. Although there has been interest in the introduction of such mechanisms in Scotland for some time, neither compulsory sale orders nor compulsory lease orders currently exist.

As such they have not been explored as part of the compulsory purchase reform programme, which is focussed on modernising existing tools rather than the creation of new ones. However, some high level questions were included in chapter 10 to help inform further consideration of compulsory sale and lease orders by the Scottish Government.
