Enforcement & Sanctions

The right to refer a rent increase will already available (from 1 April 2024 when the rent cap expires) to tenants who feel a proposed rent increase should be adjudicated by a rent officer or the First-tier Tribunal, as the case may be, with the change proposed here only amending the basis on which the decision by a rent officer/Tribunal will be taken. There is no change to the existing processes aside from applying a new calculation; there would not be any new compliance or enforcement routes.

Monitoring

Monitoring data will be available through the usual reporting routes from the RSS and the FTT. The Scottish Government will continue to engage with landlords, tenants and investors.
