6. Implementation plans
The Scottish Government has set out a timetable for implementation with the SSI introducing the changes to BCP conditions set to commence on 21 March 2026. Port operators would then be able to take their commercial decisions on whether to offer services under these amended conditions.
6.1 Post implementation review
The Scottish Government has committed to reviewing the legislation within 10 years of its implementation. Any new operations / businesses following these new arrangements will be monitored to gather evidence on its effectiveness and to inform any necessary amendments or potential extension to other areas of BCP or animal health legislation. Following implementation, the legislation will be reviewed within 10 years, though the legislation is expected to be time-limited and open to any necessary amendments or potential extension to other areas following the outcome of EU-UK SPS Agreement talks.
