The Official Controls (Location of Border Control Posts) (Scotland) Regulations 2026 - Business and Regulatory Impact Assessment

This is the final BRIA which considers the impact of the Official Controls (Location of Border Control Posts) (Scotland) Regulations 2026.

Section 4: Additional Enforcement and Compliance considerations

4. Business and Regulator Enforcement and compliance considerations

No direct enforcement plans are required for the policy proposal. Details for biosecurity enforcement, if businesses were to engage with the new requirements and should additional BCPs or altered checks at BCPs be implemented, would be developed and implemented with input from business, public authorities, and regulators.

4.1 Commencement Considerations

The proposed changes would come into force on 21 March 2026.

No compliance reporting is immediately anticipated as this is a deregulatory move that provides the potential for altered operations at specific ports. Whether operators or businesses choose to engage with the updated requirements may necessitate enforcement reporting regarding biosecurity.
