10. Contamination management
In parallel to the development of the Household Recycling Code of Practice, the Scottish Government is developing guidance to support the application of prospective local authority powers for enforcement of persistent contamination of waste receptacles.
The Circular Economy (Scotland) Act 2024 introduced powers to allow a civil means of enforcement and a fixed penalty notice procedure to be available for those who persistently and deliberately do not comply with existing obligations in relation to waste presentation and household recycling. These provisions are not yet in force. Future regulations and guidance will set out how these powers, once in force, should be used by local authorities to ensure enforcement is proportionate, appropriate and successful in preventing persistent and deliberate contamination of household waste and recycling containers.
This section of the Code is intended to outline the current enforcement measures available to address persistent contamination.
This section of the Code is likely to be revised after the provisions on civil enforcement come into force and guidance is in place. That guidance will be subject to a separate consultation.
