Equality and Human Rights Mainstreaming: Governance Framework
Sets out the Scottish Government’s approach to delivery of the Equality and Human Rights Mainstreaming Action Plan and how we will ensure senior-level ownership and visible leadership.
Legal context
The Scottish Government and public bodies operate within a legal framework that mandates the mainstreaming of equality and human rights. Key obligations stem from the Equality Act 2010 which established the Public Sector Equality Duty, requiring public authorities to pay due regard, when exercising their functions, to the need to eliminate discrimination, advance equality of opportunity, and foster good relations between persons who share a relevant protected characteristic and persons who do not. This duty is reinforced through the Scottish Specific Duties (the Equality Act 2010 (Specific Duties) (Scotland) Regulations 2012, which set out detailed requirements for certain authorities (as listed in those Regulations).
