Mental Health (Care and Treatment) (Scotland) Act 2003 Remedial Order 2026: consultation analysis and SG response

Consultation analysis and Scottish Government response on extending the ability to specify recorded matters under the Mental Health (Care and Treatment) (Scotland) Act 2003 to patients subject to forensic mental health orders.

3. Analytical approach

We reviewed all substantive free-text responses to questions 1 to 10. The analysis is structured question by question, reflecting the format of the consultation. It summarises the range and weight of views expressed. Consultation responses are self-selecting and should not be interpreted as representative of wider public opinion.

The analysis prioritises the content of responses. Where counts are used, they relate to the number of responses to each question. Illustrative quotations reflect important points raised by respondents. Quotations are used selectively and do not imply greater weight than other responses.

Some respondents answered only selected questions. Others used later questions to repeat or expand points made earlier. Where this occurred, repeated points have been reflected once within the relevant question and, where appropriate, drawn together in the conclusion.
