Statement - Screening Determination
I refer to the screening report prepared for the Marine Licensing (Miscellaneous Amendment) (Scotland) Order 2026, which was submitted to the SEA Gateway on 20 November 2025. Responses from the Consultation Authorities were received on 18 December 2019.
The Consultation Authorities agreed that the administrative provisions, to extend licensing for certain activities to areas beyond national jurisdiction (ABNJ), within the Statutory Instrument would not result in the likelihood of significant environmental effects.
I am writing on behalf of the Marine Directorate to confirm that the Scottish Government has determined, using the criteria set out in Schedule 2 of the Environmental Assessment (Scotland) Act 2005, that the Marine Licensing (Miscellaneous Amendment) (Scotland) Order 2026, is not likely to have significant environmental effects. As the Consultation Authorities agree with this view, the Scottish Government has concluded that a Strategic Environmental Assessment is not required.
I enclose a copy of the determination advert which will be place in the Edinburgh Gazette. There are no newspapers circulating in ABNJ and with no indication of where Scottish Actors that in future my fall under the legislation may be based.

The Scottish Government has determined that the above legislation is not likely to have significant environmental effects and that a Strategic Environmental Assessment is therefore not required. The screening determination can be viewed at SEA screening determinations - gov.scot. A copy of the determination can be obtained by emailing SEA_Gateway@gov.scot.
