Statement – Screening Determination
I refer to the screening report prepared for the Climate Change Plan 2026 to 2040, which was submitted to the SEA Gateway on 31/10/2023. Responses from the Consultation Authorities were received on 28/11/2023, whose overall opinion was that there is a likelihood of significant environmental effects.
I am writing on behalf of the Directorate for Energy and Climate Change to confirm that the Scottish Government has determined, using the criteria set out in Schedule 2 of the Environmental Assessment (Scotland) Act 2005, that the Climate Change Plan 2026 to 2040 is likely to have significant environmental effects. A Strategic Environmental Assessment is therefore required.
I enclose a copy of the determination advert which will be placed in the The Herald and the Edinburgh Evening News. I would be grateful if you could forward this to the SEA Consultation Authorities.

Environmental Assessment (Scotland) Act 2005: Section 8(1) Screening Determination
Climate Change Plan 2026 to 2040
The Scottish Government has determined that the above Climate Change Plan 2026 to 2040 is likely to have significant environmental effects and that a Strategic Environmental Assessment is therefore required. The screening determination can be viewed at Insert web address.
