Impact Assessments

4.58 In line with usual practice, draft Impact Assessments have been prepared.

4.59 The draft Impact Assessments that have been prepared by the Scottish Government are:

  • A draft (or partial) Business and Regulatory Impact Assessment or BRIA. This considers the costs and savings from the proposals.
  • A draft Child Rights and Wellbeing Impact Assessment or CRWIA. This considers the impact of the proposals on children and young people.
  • A draft Equality Impact Assessment or EQIA. This considers the impact of the proposals on persons holding the protected characteristics in the Equality Act 2010.
  • A Fairer Scotland Duty Assessment. This considers the socio-economic impact of the proposals. As indicated above, there are potential savings for couples who are divorcing or dissolving their civil partnership but, of course, these savings only apply when couples are going through that process.

4.60 The Scottish Government has carried out brief screening exercises for:

  • Islands Community Impact Assessment (ICIA). There is no major differential impact on the islands communities
  • Strategic Environmental Assessment (SEA). There is no significant impact on the environment.

4.61 The Scottish Government does not consider that we require to undertake a Data Protection Impact Assessment (DPIA).[12] The proposals will require the SCTS to receive personal data in relation to divorce and dissolution cases. However, the SCTS already receive personal data in these cases and any additional data would be handled and stored in the same way as the SCTS do at the moment.
