Scotland Heat Map: public sector data sharing agreement

Data sharing agreement between the Scottish Ministers and all public sector organisations holding the Heat Map datasets.


Specific limitations on data use

Some data incorporated within the Heat Map may be subject to external restrictions on use and the Scottish Government may be bound by the terms of various agreements with third-parties controlling that use. Where data is provided through other sources, recipients of such data are bound by the terms of agreements with the data owners.

Ordnance Survey data

The Scotland Heat Map contains premium data provided by Ordnance Survey. As such, sharing of Heat Map data is subject to licensing restrictions under the Public Sector Geospatial Agreement (PSGA), and so signatories need to ensure that they, and any third-party user of the Heat Map Data, has an Ordnance Survey licence in place that permits the use of the Ordnance Survey data being shared. 

Energy Saving Trust data

Heat demand layers in the Scotland Heat Map include data from Energy Performance Certificates (EPCs) as well as modelled data from Home Analytics (a product of the Energy Saving Trust).  Local authorities are the enforcement bodies for The Energy Performance of Buildings (Scotland) Regulations 2008 (last amended 2016) and have access to register data. Use of the Heat Map Data is subject to both the terms of this data sharing agreement and separate agreements between recipients and the Energy Saving Trust concerning the use of data from EPCs and Home Analytics.

Recipients must ensure that they have in place, and abide by, agreements with the Energy Saving Trust concerning the use of data from EPCs and Home Analytics.

Sharing with third-parties

Public sector signatories are permitted to share Heat Map Data with third-parties as long as:

  • the intended sharing supports the Purposes of this agreement (as outlined in the purposes of the data share section). 
  • signed project specific data sharing agreement is in place between the public sector organisation and the third-party.
  • the signed project specific data sharing agreement explicitly forbids third-party recipients from sharing the Heat Map Data with any other parties.
  • the signed project specific data sharing agreement otherwise complies with the conditions set out in this agreement and any agreement with the Energy Saving Trust concerning use of data from EPCs and Home Analytics.
  • the third-party recipient has a valid licence permitting them to use Ordnance Survey products. This licence must be in place before the Heat Map Data is shared.

Although it is necessary to have a signed data sharing agreement with third-parties, it is not necessary to have a “wet” signature. It is up to the public sector body sharing the Heat Map Data to decide how they would like signing to be completed. 

Commercial use

The Heat Map Data cannot be sold on by a signatory or third-party or used within a commercial product that is then sold on. The Heat Map Data can be used to develop and support commercial proposals that support the Purposes of data sharing outlined in section 5, subject to the terms and limitations of this
