Financial Transparency and Profit Limitation in Children's Residential Care: business and regulatory impact assessment
This is a partial impact assessment to support the ongoing development of, and consultation on, the financial transparency and profit limitation measures in Children's Residential Care brought forward by the Children (Care, Care Experience and Services Planning) (Scotland) Bill.
Section 5: Next steps and implementation
As outlined above, the Scottish Government is seeking to introduce residential childcare financial transparency measures through the Children (Care, Care Experience and Services Planning) (Scotland) Bill. The ongoing period of consultation will inform the detail of these measures.
Following this period of consultation, the financial transparency measures will be used to inform the Children (Care, Care Experience and Services Planning) (Scotland) Bill. A full BRIA with further information both in relation to the residential childcare provisions and wider provisions in the Bill will also be published at this point.
The information collected will then be used to inform any decisions made around introducing any further mechanisms around profit. No final decisions will be made on profit provisions without a clearer picture of the landscape and further consultation.
Declaration
I have read the Business and Regulatory Impact Assessment and I am satisfied that, given the available evidence, it represents a reasonable view of the likely costs, benefits and impact of the leading options. I am satisfied that business impact has been assessed with the support of businesses in Scotland.
I am also satisfied that officials have considered the impact on consumers as required by the Consumer Scotland Act 2020 in completion of the Consumer Duty section of this BRIA.
