Mental health (national secure adolescent inpatient service: miscellaneous amendments) (Scotland) regulations 2023: children's rights and wellbeing impact assessment
This report makes amendments to existing regulations and guidelines that are included in the children's rights and wellbeing impact assessment (CRWIA) published on 15 August 2024.

12. Planning for the review of impact on children’s rights and wellbeing
There are safeguards on the application of the Measures each time they are used. These include the right to ask for re-assessment of that risk, for records to be kept and for the named person to be notified. The Mental Welfare Commission also has an oversight and scrutiny role. And the principles in the Mental Health Act apply – including the concept of the best welfare of the child and young person.
The amendment to the 2015 Regulations is required to ensure children and young people detained in the NSAIS will also have the same right of appeal against detention in conditions of excessive security as those detained in other medium secure inpatient settings.
Within the NSAIS there will be an audit of searches that have been completed, incidents will be reviewed, and young people will be able to feedback via community meetings. Feedback will also be taken from young people and their parent/carer at discharge.
The Regulations also require record keeping and make provision for scrutiny and oversight by the Mental Welfare Commission.
