10. Digital Impact Test
The regulations do place restrictions on the placement of promotions viewable by customers on online web pages of retailers for instance on a checkout page or a landing page. These measures have been explored through multiple consultations and through business engagement and no evidence suggests that it will have a significant effect on businesses that sell products online. The regulations align with England and Wales, with many businesses having been subject to equivalent regulations in England since 2022, and it is expected that many large intra-UK businesses will have applied these for Scottish customers during this period. Given the restrictions align across other parts of the UK, it is not expected there will be a significant effect on digital requirements of private organisations.
The measures introduce no new specific requirements on digital delivery across the public sector.
