Brexit: secondary legislation – index

Information about secondary legislation and Scottish statutory instruments in the event of a 'no deal' Brexit scenario.

Statutory instruments (SIs)

Notifications have been sent according to the Protocol on obtaining the approval of the Scottish Parliament to the exercise of powers by UK Ministers under the European Union (Withdrawal) Act 2018 in relation to proposals within the legislative competence of the Scottish Parliament.

Where corrections are to be legislated for in a SI, the Scottish Government must prepare a document notifying the Scottish Parliament of its intention to consent to devolved matters being included in the SI.

The relevant Parliamentary Committee will then scrutinise Scottish Ministers’ intention to consent. These notifications will be prepared for each policy area and describe the legislation impacted, the nature of the deficiencies, the proposed corrections and why these are necessary in the event there is no deal with the EU.

The majority of notifications relating to environmental legislation have now been made.

See the UK Government website for a list of UK-wide EU Withdrawal Act 2018 statutory instruments and accompanying explanatory memorandums. UK wide statutory instruments require collaboration among all devolved administrations.
