This guidance is intended to assist social and private landlords to comply with
their duties under the Investigation and Commencement of Repair (Scotland) Regulations 2026 which come into force on 6 October 2026.

For example, following your report of mould in your home on 29 October 2026, I [the landlord] am writing to confirm the outcome of my investigation and the actions I will now take.
During the visit of 2 November 2026, mould growth was found behind your kitchen cabinets alongside a broken extractor fan. A mould wash was conducted on-site to remove the mould. Having considered the findings, I have determined that substantial mould is present and that the main cause of the mould is because of the broken extractor fan.
Because of this, Awaab’s Law duties apply and I will take the following steps to prevent the mould re-occurring:
- Arrange repair of extractor fans in kitchen within 7 working days.
- A follow-up inspection will take place on 23 November, subject to your confirmation, to confirm resolution and provide a demonstration to the tenant on utilising the extractor fan.
