This report outlines the findings of a survey we carried out as part of a review of The Animals and Wildlife (Penalties, Protections and Powers) (Scotland) Act 2020, which made a number of amendments to animal welfare, animal health and wildlife legislation.

About this privacy notice

This privacy notice explains how your personal data (e.g. any information that could identify you such as name and email address) collected for the purposes of this research will be used and handled. The Scottish Government is the “data controller” for this study, as Scottish Government researchers will be responsible for securely storing the data you provide and analysing it. You are being contacted about this survey as we have identified you as working in an area or areas that may have been affected by the Animals and Wildlife (Penalties, Protections and Powers) (Scotland) Act 2020, namely Marine Wildlife, Terrestrial wildlife and/or Animal Health and Welfare.

Who are we?

Rural and Environment Science & Analytical Services Division (RESAS) is a Scottish Government department that is responsible for statistics and scientific, economic and social research on agriculture, food, environment and rural issues.

We are conducting a survey to understand the impacts of amendments made to animal welfare, health and wildlife legislation through the Animals and Wildlife (Penalties, Protections and Powers) (Scotland) Act 2020. The survey will form part of a wider legislative review. The review is being conducted by RESAS on behalf of the Scottish Government Animal Welfare Team within the Animal Health & Welfare Division. The review will also include a series of workshops building on the survey findings. The final review will be published in a report by 1st April 2025. It is a legal commitment to review this act and you are being contacted because your organisation is likely to be impacted by the changes outlined in the Act. Completing the survey will ensure adequate data is available to determine the impacts of the Act and will also positively impact on the design and quality of the subsequent workshops.

What information do we collect about you?

If you agree to take part in the research, we will collect and process the following data about you:

  • Demographic information limited to the job sector you are employed in
  • Information you give in answering the surveys relating to your views and opinions about the performance of the centre(s), including optional open text response
  • A contact email address so that we can update you on upcoming consultations and /or to conduct follow-up research, only if you choose to supply them.

The survey invitation (web link) will be disseminated by RESAS using a mailing list supplied by the Scottish Government Animal Welfare Team who already hold the email address of intended recipients on record. This contact information will only be used by RESAS for the purposes of disseminating the survey.

What is our lawful basis for collecting and using your personal information?

Participation in the survey is voluntary and you can withdraw at any time before you submit your responses. The legal basis for processing personal data is the performance of a task carried out in the public interest.

We are collecting this data in the performance of a public task, under Article 6(1)(e) of the UK GDPR, and in accordance with Section 16 of the Animals and Wildlife (Penalties, Protections and Powers) (Scotland) Act 2020.

How will we use your information?

The information you provide in completing the survey will be analysed by Scottish Government researchers, and anonymously summarised in a final report.

The survey is anonymous. You have been sent the survey invitation link by RESAS on behalf of the Animal Welfare Team because they already hold your e-mail address. The Animal Welfare Team will not receive the survey responses. RESAS shall receive the survey responses. Any quotes used will be anonymous by default. In the event that open text responses contain information that could reveal your own or someone else’s identity this information will be anonymised and/or redacted. The information gathered in this survey will be used for research purposes only and dealt with in accordance with data protection legislation.

Who will we share your information with?

We will not share your personal information with any other groups. The final report findings will be published by April 2025. The research data and any quotes will be anonymised in this report.

Will we send your information outside the UK?

No, we do not transfer your information outside the UK.

How long will we store your information?

The survey will be administered using Microsoft Forms. The survey data will be stored electronically on the Scottish Government’s electronic Record and Document Management system (eRDM) with access restricted to the internal project team.

The anonymised survey data will be retained until the project is complete. It will then be deleted within 6 months of the final report. The information will be stored on a secure server and in line with data protection legislation.

If you choose to provide your email address to receive updates on upcoming consultations it will also be passed to the Disease Control Branch: Endemic Diseases unit of the Animal Health and Welfare Division in Scottish government, stored securely and used for this purpose only.

If you choose to provide your email address to participate in follow-up workshops or other research related to this legislative review it will only be held by RESAS and the Animal Welfare Team within Scottish Government, stored securely, and used only for research purposes relating to this review. RESAS will delete this data at the end of the project.

What are my rights in relation to the information held about me?

You have the right to request a copy of the personal data that we hold about you. If you would like a copy of some or all of your personal data, you can find more information on how you can do this by visiting online.

We want to make sure that your personal data is accurate and up to date. You may ask us to correct or remove personal data you think is inaccurate.
