Addendum to Final Business and Regulatory Impact Assessment for the Deposit and Return Scheme for Scotland Regulations 2020: October 2026
This is an Addendum to the Final Business and Regulatory Impact Assessment for The Deposit and Return Scheme for Scotland Regulations 2020 (as amended by the DRS Amendment Regulations 2026); and the DRS for Scotland (Designation of Scheme Administrator) Order 2026.
Conclusion
51. The proposed amendments represent targeted and proportionate changes designed to support the successful implementation and operation of the Deposit Return Scheme.
52. The changes will strengthen the regulatory framework by ensuring SEPA is appropriately resourced and empowered to carry out its responsibilities in relation to the functions of the scheme administrator, increase alignment with arrangements in other UK nations, provide greater operational flexibility for the hospitality sector and allow interest on late payment of producer registration fees.
53. Some businesses may face changes to existing plans as a result of the proposed amendments. These impacts are expected to be limited and manageable. The proposed amendments relating to the hospitality sector and export shops have been supported by affected stakeholders following engagement and during their implementation of the DRS. Proposals have been subject to consultation with SEPA, the scheme administrator, and industry representatives.
54. Overall, the amendments are expected to have a positive net impact by improving regulatory certainty, supporting the effective operation of the scheme, and facilitating an interoperable DRS across the four nations.
