Addendum to Final Business and Regulatory Impact Assessment for the Deposit and Return Scheme for Scotland Regulations 2020: October 2026

This is an Addendum to the Final Business and Regulatory Impact Assessment for The Deposit and Return Scheme for Scotland Regulations 2020 (as amended by the DRS Amendment Regulations 2026); and the DRS for Scotland (Designation of Scheme Administrator) Order 2026.

Enforcement/ compliance

49. SEPA are the regulator responsible for monitoring and enforcing compliance with the scheme in Scotland. The proposed amendments ensure that, from the date after the Regulations come into force, SEPA will have the necessary powers to recover its regulatory costs from the scheme administrator, Exchange for Change, and undertake enforcement activities in relation to the functions of the scheme administrator in advance of scheme implementation.

50. Enabling interest to be charged on late payment of producer registration fees is also expected to support compliance.
