Young performers licensing guide

A guide to organising performances, licensed sporting or modelling activities involving children and young people.


Considering a licence request

Submit applications at least 21 days before the first performance or activity.  

Licensing authorities can choose to process late applications but are not required to do so. Allow the full 21 days to make sure the authority has enough time to assess your application properly. 

Under section 37(4) of the Children and Young Persons Act 1963, a licence can only be granted if the authority is satisfied that: 

  • the child is fit to take part 

  • proper arrangements are in place for the child's health, safety and welfare 

  • the child's education will not suffer, and where needed, tutoring will be provided while they are away from school 

  • taking part does not put the child at any greater risk than in their normal daily life 

Getting additional information 

Even if the application and risk assessment appear complete, the licencing authority can ask for more information if needed. They may contact: 

  • the applicant 

  • the child 

  • the child's parent or guardian 

  • the head teacher 

  • the child's GP, particularly if a medical condition has been declared 

  • the proposed chaperone 

  • the proposed private tutor 

Any requests for information must focus on the child's best interests. Authorities should only ask for what is necessary to make their decision. If the authority needs to speak with the child directly, it must follow its safeguarding and wellbeing procedures. 

Under Part 4 of the Children and Young People (Scotland) Act 2014, any information provided by the Named Person must be proportionate and targeted. While the 2014 Act creates a duty to share information, this must be done within clear principles and boundaries, including those set out in the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. The Information Commissioner's Office provides further guidance on data sharing.
