We are consulting on a broad range of areas centred on parole improvements and parole reform. The consultation invites all people with an interest in parole and wider justice matters to consider the consultation areas and play a direct role in influencing parole policy in Scotland.

Annex C - Licence Conditions Template

The Parole Board use the following template when recommending licence conditions for persons who have been recommended (to Scottish Ministers) that they be released under supervision (and on licence) by justice social work.

Supervising Officer

1. You shall report on the day of release to the officer in charge of the office at the address notified to you at the time of release;

2. You shall be under the supervision of an officer to be nominated for this purpose from time to time by the Head of Service with responsibility for criminal justice social work in AUTHORITY Council;

3. You shall comply with any requirements that officer may specify for the purposes of risk management supervision;

4. You shall inform your supervising officer immediately if you are detained or arrested by the police, or are questioned by the police;

5. You shall keep in touch with your supervising officer, as instructed by that officer;

6. You shall inform your supervising officer if you change your place of residence, gain employment, or change or lose your job;

Good behaviour

7. You shall be of good behaviour and shall keep the peace;

Travel outside the United Kingdom

8. You shall not travel outside the United Kingdom without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;

Accommodation

9. You shall reside only in suitable accommodation, supported or otherwise as approved by your supervising officer, and subject to any restrictions that officer may impose;

Employment

10. You shall co-operate with an organisation experienced in job search and advice for offenders, as directed by your supervising officer;

Offence-focussed work

11. You shall undertake offence-focussed work, in particular SUBJECT, as directed by your supervising officer;

Mental health

12. You shall undertake an assessment by community mental health services, and co-operate with services after this, all as directed by your supervising officer;

Victims

13. You shall not approach or communicate in any way, or attempt to approach or communicate in any way, either directly or indirectly, with NAME without the prior approval of your supervising officer and subject to any restrictions that officer may impose, and shall immediately report any unavoidable or inadvertent approach or communication in any way to that officer;

Geographic exclusion

14. You shall not enter the area(s) of AREA as defined by your supervising officer, without the prior approval of that officer;

Addictions and dependencies

15. You shall: (delete as applicable)

a) undertake an assessment for alcohol misuse counselling, and:

(i) undertake any such counselling, as directed by your supervising officer;

(ii) undertake testing, random or otherwise for alcohol, as directed by your supervising officer;

(iii) not approach or communicate in any way, or attempt to approach or communicate in any way, either directly or indirectly, with persons whom you know to be, or should have reasonable cause to believe may be persons who misuse alcohol without the prior approval of your supervising officer and subject to any restrictions that officer may impose, and you shall immediately report any unavoidable or inadvertent approach or communication in any way to that officer;

(iv) not enter any licensed premises, for any reason without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;

b) undertake an assessment for substance misuse counselling, and:

(i) undertake any such counselling, as directed by your supervising officer;

(ii) undertake testing, random or otherwise for substances, as directed by your supervising officer;

(iii) not approach or communicate in any way, or attempt to approach or communicate in any way, either directly or indirectly, with persons whom you know to be, or should have reasonable cause to believe may be persons who misuse substances or are concerned in the unlawful supply of substances without the prior approval of your supervising officer and subject to any restrictions that officer may impose, and you shall immediately report any unavoidable or inadvertent approach or communication in any way to that officer;

c) undertake an assessment for problem gambling counselling, and:

(i) undertake any such counselling, as directed by your supervising officer;

(ii) not enter any premises such as bookmakers or casinos which are licensed to allow gambling, or other premises where gambling is habitually carried out, for any reason without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;

(iii) not access any online gambling sites of any sort, for any reason without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;

Work

16. You shall not undertake paid, unpaid or voluntary work without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;

Contact with children

17. You shall not approach or communicate in any way, or attempt to approach or communicate in any way, either directly or indirectly, with any child who you know to be, or should have reasonable cause to believe may be under the age of 18 years without the prior approval of your supervising officer and subject to any restrictions that officer may impose, and shall immediately report any unavoidable or inadvertent approach or communication in any way to that officer;

18. You shall not enter parks, playgrounds or any other places where children who you know to be, or should have reasonable cause to believe to be under the age of 18 years are likely to be, or might reasonably expect them to be, without the prior approval of your supervising officer and subject to any restrictions that officer may impose, and shall immediately report any unavoidable or inadvertent entry to that officer;

Information technology

(Either condition 19 or 20 may be used, but not both)

19. You shall:

  • not own or possess more than one mobile phone and more than one computer (whether desktop, laptop or otherwise), games console, smart watch, smart TV or similar equipment capable of accessing the internet, without the prior approval of your supervising officer;
  • not own or possess any such device without advising your supervising officer of the serial number and any passwords for said device, and shall not use said device until you have received confirmation from that officer that they have received the serial number and any passwords, subject to any restrictions that officer may impose;
  • not access the internet via any other device without the express written prior approval of your supervising officer, and subject to any restrictions that officer may impose;
  • not use any telephone number or email address without first advising your supervising officer of that number or address, and subject to any restrictions that officer may impose;
  • not install any third-party application on any such device without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;
  • not use any encryption on any such device, for any purpose;
  • not delete any search history, or use incognito tab or private browsing mode on any such device used by you;
  • not access, or otherwise use in any way any social networking site without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;
  • allow monitoring of any such device, as directed by your supervising officer;
  • allow your supervising officer, or others acting on their instructions with their consent, to inspect any such device used by you when requested to do so, with or without advance notice;

20. You shall:

  • not have any means to access the internet at home or at any other location, and shall not access the internet at home or at any other location, or store information stored from the internet without the prior approval of your supervising officer, and subject to any restrictions that officer may impose;
  • allow monitoring of any computer, mobile phone or other equipment you have been granted approval to use, which is capable of accessing the internet or of storage of electronic data, as directed by your supervising officer;
  • allow police officers and social workers responsible for or involved in your supervision, or others acting on their instructions, to inspect any electronic equipment used by you and capable of accessing the internet or storing electronic data, when requested to do so, with or without advance notice;

Association with sex offenders

21. You shall not approach or communicate in any way, or attempt to approach or communicate in any way, either directly or indirectly, with any person whom you know to be, or should have reasonable cause to believe may be sex offenders without the prior approval of your supervising officer and subject to any restrictions that officer may impose, and shall immediately report any unavoidable or inadvertent approach or communication in any way to that officer;

Relationships / contacts

22. You shall:

a) immediately inform your supervising officer of any friendships, associations, or intimate or domestic relationships that you enter into, with anyone;

b) provide your supervising officer with the identities, and all contact information which you have in relation to them, of persons, as that officer may require, who you have spoken to or communicated with either directly or indirectly, during any period(s) that officer may specify;

(Either condition 23 or 24 may be used, but not both)

Electronic monitoring

23. You shall comply with electronic monitoring and remain within the confines of your approved address between the hours of TIMES, or between such other hours as directed by your supervising officer, subject to a maximum of 12 hours per day;

Curfew

24. You shall remain within the confines of your approved address between the hours of TIMES, or between such other hours as directed by your supervising officer, subject to a maximum of 12 hours per day;
