Climate Change (Scotland) Act 2009 (Scottish Carbon Budgets) Amendment Regulations 2025: statement

A statement to accompany the Climate Change (Scotland) Act 2009 (Scottish Carbon Budgets) Amendment Regulations 2025 as required under the Climate Change (Scotland) Act 2009. It provides information on the Regulations and indicates the likely proposals and policies in the next Climate Change Plan.


Purpose of this statement

This statement sets out the required information to be published on the same day as the draft regulations setting Scottish carbon budget levels are laid in Parliament, in accordance with sections A4(5), A4(6) and A4(7) of the 2009 Act. Under these provisions, this statement must:

  • set out, in respect of each Scottish carbon budget, the extent to which the proposed carbon budget takes account of the target-setting criteria as set out in section 2B of the 2009 Act,
  • set out whether, in respect of each Scottish carbon budget, the proposed carbon budget is in accordance with the most up-to-date advice that Scottish Ministers have received from the CCC and, if it is not, the reasons why,
  • set out, in indicative terms, the proposals and policies in relation to each of the sectors mentioned in section 35(3) of the 2009 Act, which are likely to be set out in the next CCP due to be laid before the Scottish Parliament, if the regulations are approved,
  • state whether Scottish Ministers expect that during the period covered by a Scottish carbon budget that would be set by the regulations, the net Scottish emissions account for a year will be 75% and 90% lower than Baseline for the first time.
