The Official Controls (Location of Border Control Posts) (Scotland) Regulations 2026 - equality impact assessment

The EQIA establishes an additional case and conditions under which a Border Control Post may be situated at a distance other than in the immediate vicinity of a point of entry.


Background

The Scope of the EQIA

The EQIA has demonstrated that the proposals only have the potential to impact businesses or operators acting that choose to engage with the proposed changes, and the changes only impact BCPs within the same freeport zone/boundaries. No topics of concern were raised and there is no evidence to suggest that specific persons will be impacted by the proposals. The impact of the proposals is limited and does not impose any additional impacts on any individuals falling within any of the current protected characteristics when compared to the existing policy.

Key Findings

The instrument would only directly impact operators that choose to engage with the updated conditions for BCPs and alter the use of existing infrastructure or invest in new facilities for reasons of business, trade, or travel. The overall impacts of the proposals, as a deregulatory move, is anticipated to be neutral to positive for businesses, workers, and Scotland’s communities in general.

It is considered there are neutral impacts for each protected characteristic under each of the three Public Sector Equality Duties (PSED) needs.
