Island communities impact assessment for School Transport Guidance

This Island Communities Impact Assessment (ICIA) has been undertaken to consider whether the updated School Transport Guidance is likely to have any effect on island communities that is significantly different to its effect on other communities (including other island communities).


1. Step one – develop a clear understanding of your objectives

The revised School Transport Guidance, announced for review in November 2024 and updated during 2025 following stakeholder consultation, clarifies local authorities’ statutory duties under the Education (Scotland) Act 1980, focusing on pupil safety and compliance with related legislation such as the Seat Belts on School Transport (Scotland) Act 2017, the Additional Support for Learning (Scotland) Act 2004, and the Protection of Vulnerable Groups (Scotland) Act 2007. It also addresses operational issues including contracting arrangements, pupil behaviour, the transition to zero-emission vehicles, and complaints handling. The guidance promotes safe, inclusive, and sustainable transport arrangements, encouraging a flexible, rights-based approach to ensure equitable access for all pupils, particularly those with protected characteristics.

The guidance provides clarification rather than introducing new statutory duties or altering eligibility criteria and therefore does not create new obligations or impacts for island communities. Existing mitigations, such as ferry timetable coordination and local transport links, remain in place to address geographic challenges. References to island-specific issues reflect pre-existing operational factors managed under statutory duties, and no new impacts are introduced. The review aimed to incorporate the Young Persons Free Bus Travel Scheme and improve clarity on assessing walking route safety. Overall, the guidance strengthens consistency in interpreting statutory duties, safeguards pupils, and supports sustainable travel options, contributing to national outcomes for children, education, and the environment.
