Post Office (Horizon System) Offences (Scotland) Act 2024 implementation: statutory report

This statutory report to the Scottish Parliament on the implementation of the Post Office (Horizon System) Offences (Scotland) Act 2024 outlines the steps taken by the Scottish Government to fulfil its statutory duties under Section 6 of the Act.


6. Data and Statistics

6.1 Quashed convictions and alternatives to prosecution

As of February 2026, a total of 100 cases had been identified where convictions or alternatives to prosecution may be within the scope of the Act.

All 100 of these cases have been assessed, with 64 convictions identified as quashed, one alternative to prosecution deleted, and 35 convictions identified as not quashed.

Of the 65 individuals with convictions identified as quashed (64) and an alternative to prosecution deleted (one), 62 individuals – or their personal representative – have been traced and notified that their conviction has been quashed and of their eligibility to access redress.

All criminal records for these 65 individuals have been updated, with notification of the updating of records made to the 62 traced individuals.

Three individuals remain untraced, and the Scottish Government continues to take all reasonable efforts in locating the respective individuals. This includes ongoing engagement with HMRC and DVLA in respect of address checking.

6.2 Compensation claims

As of December 2025, 52 out of the 64 individuals with convictions quashed under the Act have applied to the Horizon Convictions Redress Scheme administered by the Department of Business and Trade.

6.3 Convictions not identified as quashed

All 35 convictions assessed as not quashed did not meet condition E under the Act[10], [11].
