I understand that the Scottish Government received approximately £97.1 million during the 2021/22 financial year.

1. How much has been spent to date ?

2. Which projects was the money spent on ? ( Breakdown per project with supporting documentation )

3. What is the remaining balance of the funding received ?

4. What is the future planning for the balance and timeline for implementation ?

5. Where is the money located , and what annual interest is being accrued ?

6. Is this money ring fenced for the original intended use ?

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

2 to 5. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), the Scottish Government is not required to provide information which it does not have. The Scottish Government does not have some of the information you have requested. This exception applies to questions 2-5 of your request for the following reasons:

The Scottish Government received £97.1 million in Barnett consequentials for 2021-2022. Barnett consequentials that arise from UK Government’s spending decisions are not ringfenced, and form part of the block grant received by the Scottish Government from the UK Government. Funding for the Cladding Remediation Programme is allocated through the annual Scottish Budget process, therefore information on funding balances, forecasts, location or interest accrued specifically in relation to the consequentials received in 21-22 is not held.

This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. While we recognise that there may be some public interest in this information, clearly we cannot provide information which we do not hold.
