Energy Performance of Buildings (Scotland) Regulations 2025: data protection impact assessment

Data protection impact assessment (DPIA) produced as part of our intention to lay updated Energy Performance Certificate (EPC) regulations in October 2025. This DPIA has considered the evidence to understand any potential data protection outcomes from the reform of EPCs.

Interest: Required by regulations to provide an EPC to prospective buyers/tenants

Group: Current/prospective homeowners/tenants

Interest: Can review EPC before deciding to purchase/rent a property. Will inform them of the energy efficiency of the property

Group: EPC Assessors

Interest: Complete an on-site survey to create an EPC

Group: AOs

Interest: Accredited EPC assessors and complete audits of their work. AOs may also offer other retrofit services.

Group: Housing Authorities

Interest: EPC data of interest to assist with stock modelling and requirement to provide EPCs to prospective tenants

Group: Local Authorities

Interest: Enforcement Authority for EPB regulations

Group: Finance providers / Mortgage lenders

Interest: May have interest in providing products based on EPC ratings

Group: Academics studying energy efficiency and decarbonisation

Interest: Interest in modelling housing stock, decarbonisation, energy efficiency and policy analysis

Group: Retrofit professionals and supply chains

Interest: Interest in provided energy efficiency and heat decarbonisation products/services

Group: Estate agents, letting agents and legal professionals

Interest: Requirement to ensure that valid EPC is being made available to prospective owners and tenants.
