12. Planning for the review of impact on children’s rights and wellbeing

- When will you review and update the CRWIA if required?
Following publication, reports on the operation of the Scheme will be published on an annual basis as close as possible to World Children’s Day each year and accompanied by a child-friendly version. Each report will include a summary of actions taken for the purpose of compliance with the section 6 duty and securing better or further effect of the rights of children during the reporting period, as well as a summary of actions that the Scottish Ministers intend to take in the next reporting period.
Section 16 (2) of the UNCRC states that at the end of each reporting period the Scottish Ministers must take into account the following things when reviewing the Scheme:
- Any reports, suggestions, general recommendations or other documents issued by the UN Committee on the Rights of the Child (“the Committee”) relating to the implementation of the UNCRC or its optional protocols by the United Kingdom that the Scottish Ministers consider relevant;
- an amendment to the UNCRC or to an optional protocol to the UNCRC entering into force;
- a General Comment made by the Committee;
- views and findings adopted by the Committee under the third optional protocol;
- recommendations made by the Committee following days of general discussion;
- any protocol to the UNCRC ratified by the United Kingdom; and
- a strike down declarator or an incompatibility declarator made by a court.
If there are any new actions, the Scottish Ministers must consult (in relation to those actions) with:
- children and young people;
- the Commissioner for Children and Young People in Scotland;
- the Scottish Human Rights Commission; and,
- such other persons as the Scottish Ministers consider appropriate.
The first Children’s Rights Scheme will remain in place for at least three years, until November 2028, after which it will be reviewed and an updated CRWIA will be published with each new version of the scheme.
