Recommendations/ preferred options

The Care Reform (Scotland) Act 2025 was unanimously passed by the Scottish Parliament in June 2025. The regulations will give statutory effect to the policy and are scheduled to be introduced in early 2026 and will come into force before the end of the current Parliamentary Session.

Implementation considerations/ plan

The regulations will come into effect on 31 March 2026. An accompanying code of practice will be issued at a later date.

Post implementation review

The Scottish Government will prepare a report two years after the legislation comes into force. If there are any findings on the effect on businesses, these will be included in the report.

Declaration

I have read the Business and Regulatory Impact Assessment and I am satisfied that it represents a fair and reasonable view of the expected costs, benefits and impact of the policy, and that these have been taken into account when making the policy decsion. I am satisfied that business impact has been assessed with the support of businesses in Scotland.
