A4: authorisation to feed category 3 material and certain category 2 material to reptiles and non-birds of prey other than zoo or circus animals

The Scottish Ministers for the Scottish Government, acting as the Competent Authority for Scotland in respect of the following EU Regulations:
- Regulation (EC) No 1069/2009* of the European Parliament and of the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002
- Commission Regulation (EU) No 142/2011* of 25 February 2011 implementing Regulation (EC) No 1069/2009 of the European Parliament and of the Council
Authorisation to feed category 3 material and certain category 2 material to reptiles and non-wild birds of prey other than zoo or circus animals
In accordance with Articles 16(c) and 18(1)(c) of Regulation (EC) No 1069/2009 the Scottish Ministers authorise by way of derogation from Articles 13 and 14 of Regulation (EC) No 1069/2009 the feeding to reptiles and non-wild birds of prey other than zoo or circus animals of:
- Category 2 material, provided –
(a) it comes from animals which were not killed or did not die as a result of the presence or suspected presence of a disease communicable to humans or animals; or
(b) it comes from imported breeding and productive poultry other than ratites, and day-old chicks other than of ratites that have fulfilled the requirements applicable after imports in accordance with Annex VIII of Regulation (EC) No 798/2008; and
- Category 3 material,
Provided that, except for final users, the conditions of Section 1, Chapter 1, Annex VIII of Commission Regulation (EU) No 142/2011 are complied with to ensure the control of risks to public and animal health.
This authorisation applies in Scotland.
