Tree replacement enforcement notice appeals: form and guidance

You have the right to make a tree replacement enforcement notice appeal to Scottish Ministers where a planning authority:

  • serves a notice requiring you, within a set period, to plant a tree or trees of such size and species as specified

The attached guidance explains:

  • how to submit documents to the DPEA electronically
Warning

Your appeal must be made before the date that the notice is due to come into effect. This date will be clearly stated on the notice itself. You must also send a copy of the appeal to the relevant planning authority.

 

There is no fee for this type of appeal. Everybody who participates in the process is normally expected to cover their own expenses.
