The definition is in section 149(7) of the Equality Act 2010 (and is necessary because the second two parts of the public sector equality duty (that is, advancing equality of opportunity and fostering good relations) apply only to the listed relevant protected characteristics (but the first part, to eliminate discrimination, applies to all of them).
