Onshore Electricity Generation: Consultation on increasing the threshold for applications under The Electricity Act – Partial Business And Regulatory Impact Assessment (BRIA)

This Partial Business and Regulatory Impact Assessment (BRIA) estimates the costs, benefits and risks linked to increasing the 50MW threshold which determines whether applications for onshore electricity generating stations are decided by Scottish Ministers or by the relevant planning authority.


Section 4: Additional implementation considerations

Enforcement / compliance

Any change to the 50MW threshold would be implemented through an order which would require to be laid before the Scottish Parliament. Planning authorities hold a wide range of powers to enable their monitoring and enforcement of planning controls.

Internal Market / Intra-UK Trade

Any change to the 50MW threshold is not likely to impact on the internal market or intra-UK trade.

International Trade Implications

Any change to the 50MW threshold is not likely to have any effect on international trade or the importation/exportation of goods.

EU Alignment consideration

We do not envisage any implications regarding EU alignment because of this change.

Legal Aid

As far as we are aware these proposals will have no impact in relation to Legal Aid, as the policy does not introduce any new procedures or right of appeal to a court or tribunal.

Digital impact

We do not envisage that changing the 50MW threshold would have any significant impact on digital platforms.

Business forms

We do not envisage that any new business forms will be introduced as a result of this change.
