Correspondence relating to individuals being banned from licensed premises: FOI release

Information requested

1. Copies of any correspondence sent to Scottish Ministers, Special Advisers, or the Scottish Government by:

a) Sir Tom Hunter, or on his behalf, and/or

b) members of the general public, which relates to requests, suggestions, or representations that individuals be banned from pubs or other licensed premises.

2. Copies of any responses to such correspondence and any internal Scottish Government correspondence, briefings, or discussions that reference or relate to these matters,

in the last month from this email.

Response

I enclose a copy of some of the information you requested.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies to that information.

The exemption under section 38(1)(b) (personal information) applies to a small amount of the information requested because it is the personal data of a third party, i.e. the names or contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
