Children’s Rights and Wellbeing Impact Assessment (CRWIA) information: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

Copies of the Children’s Rights and Wellbeing Impact Assessments (CRWIA) that informed the following:

  • Scotland's Vision for Kinship Care: Our Offer of Support for Families (published on 22 December 2025)
  • Schools (Consultation) (Scotland) Act 2010: guidance (published on 19 Dec)
  • School age childcare services - regulation review: feasibility study – final options appraisal (published on 17 December 2025)
  • School premises regulations - updating proposals: consultation (published on 16 December 2025)

Response

There is no requirement to publish a CRWIA alongside a draft proposal. Scotland's Vision for Kinship Care: Our Offer of Support for Families was published on 22 December 2025 to consult on this draft vision and offer. The Vision has been developed in line with existing children’s rights frameworks, including the UNCRC Act, Getting it Right for Every Child (GIRFEC) and The Promise. Children’s rights and wellbeing considerations are therefore reflected throughout the document.

The policy team are currently scoping the programme of impact assessments that will accompany the next phase of policy development, including where these will link to the Children (Care, Care Experience and Services Planning) (Scotland) Bill.

Formal impact assessments (including CRWIA and an Equality Impact Assessment (EQIA)) will be undertaken on any substantive policy or legislative changes that are taken forward following consultation and ministerial decisions.

The CRWIA for the Schools (Consultation) (Scotland) Act 2010 guidance (published on 19 Dec) is due to be published within 12 weeks of the request being made. Under section 27(1) of FOISA, we are not required to provide information which is intended for future publication within 3 months of the request.

The School Age Childcare Programme Review of Regulation Feasibility Study – Final Options Appraisal Scottish Government and Care Inspectorate is an appraisal of possible options, not an assessment of agreed policy change. No decision has yet been made on implementing any specific changes, as the Scottish Government will explore the options set out in the study in more detail. Therefore, no CRWIA was undertaken on the Feasibility Study Final Options Appraisal.

However, the study was undertaken as part of the Scottish Government’s School Age Childcare Programme and a CRWIA for the Programme was published in November 2023.

Additionally, as part of this process to investigate the introduction of a new definition for School Age Childcare, “Model A” within the document, a CRWIA was begun in December 2025. It will inform the exploration and development of this potential change.

There is no requirement to publish a CRWIA alongside a consultation document. The CRWIA for School premises regulations will be informed by responses to the School premises regulations: updating proposals consultation, published on 16 December 2025. The team confirmed that following the FOI receipt, they engaged with the Children and Young People’s Commissioner for Scotland’s office to inform them of this and offered a meeting to discuss.
