Information request and response under the Environmental Information (Scotland) Regulations 2004
Information requested
Information in relation to 20mph speed limits for Lochearnhead, Strathyre, Callandar, Crianlarich, St Filans and Comrie.
Q1 - Can I ask that you confirm when the other villages mentioned were assessed (was it at the same time?) and can you please make copies of the assessments for all of the villages mentioned as well as Lochearnhead available please?
Q2 - Can you please confirm when a more up to date assessment can be carried out to support the action required to remedy the current speed limit, which is now inappropriate and potentially dangerous.
Q3 - I'd be interested in any data you have on traffic volumes between January 2023 and September 2025?
Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
To aid my response, I have answered your questions in the order that they were received.
Q1 - Can I ask that you confirm when the other villages mentioned were assessed (was it at the same time?) and can you please make copies of the assessments for all of the villages mentioned as well as Lochearnhead available please?
A1 – All assessments took place in January 2023. This included Callander, Strathyre, Comrie, Crainlarich, St Fillans and Lochearnhead.
Please see Annex A to H for a copy of the assessments.
Q2 - Can you please confirm when a more up to date assessment can be carried out to support the action required to remedy the current speed limit, which is now inappropriate and potentially dangerous.
A2 – Our programme for 2026/2027 will include a review of the Lochearnhead against the criteria for a 20mph speed limit.
Q3 - I'd be interested in any data you have on traffic volumes between January 2023 and September 2025?
A3 – Please see Annex G for information related to traffic volumes
