Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
1. By year, from the end of the 2015-16 financial year to present:
- Annual budget of the Equality, Inclusion and Human Rights Directorate.
- Number of employees in the Equality, Inclusion and Human Rights Directorate.
- Number of contingent workers in the Equality, Inclusion and Human Rights Directorate, and of these, number of contractors employed.
- Mean, median, 75th percentile, and 90th percentile salary of employees of the Equality, Inclusion and Human Rights directorate.
2. The responsibilities of the Equality, Inclusion and Human Rights directorate at that moment in time.
3. The current objectives of the Equality, Inclusion and Human Rights directorate.
The Directorate Business Plan for 2024/25 and 2025/26 sets out the main delivery priorities of work being undertaken by teams across the Directorate - see document annex C attached.
4. An account of work done since 1 January 2020 to assess the efficacy and value provided of the Equality, Inclusion and Human Rights directorate.
5. A list of names of reports, internal publications, and external publications produced by the Equality, Inclusion and Human Rights directorate since 1 January 2024.
Response
I enclose a copy of some of the information you requested.
The Equality, Inclusion and Human Rights Directorate was established in December 2020. I have therefore only provided information from financial years 2021/22 to 2024/25.
When considering the information provided please be aware that there was a significant change to the remit and structure of the Directorate in 2024/25. There had previously been a separate Directorate for Ukraine Resettlement (established in 2022) but due to a reduction in its size it was redesignated as a Division and incorporated into the Equality, Inclusion and Human Rights Directorate.
I can confirm that we hold information relevant to all parts of your question 1. You can find this in table format in Annex A.
Question 2 is open to some interpretation. There are a variety of ways in which the “responsibilities” of the Directorate could be defined with different levels of specificity from overall mission to strategic aims to individual delivery actions. I have provided in Annex B, information held on our electronic documents record management system which sets out a comprehensive view of the overall purpose of the Directorate and its areas of delivery.
I have made that same interpretation as above in relation to the current objectives of the Directorate. The information provided in Annex C reflects the lowest level of detail available collated into a single cross- Directorate document and which is used to inform senior leadership oversight of delivery.
We do not hold information in relation to our question 4 based on my interpretation of this part of the request as concerning a specific and targeted assessment of the 'efficacy and value' of the Equality, Inclusion and Human Rights Directorate, above and beyond the governance and financial management processes, including budget setting and in-year savings review commissions, which apply to the Scottish Government as a whole. The broader interpretation covering those wider processes would require a significantly more extensive search to identify and collate.
In relation to question 5, I have interpreted "reports" to mean final and completed documents which have been provided to Scottish Government colleagues or Ministers. I have interpreted "internal publications" to be information made available outwith the Directorate across Scottish Government on the Saltire intranet service. I have interpreted "external publications" to mean any information that has been made publicly available through the gov.scot website or through printed hard copies that could be requested. The latter category of information is subject to section 25 of FOISA (information otherwise accessible) and the Scottish Government does not need to provide you with that information. However to assist you I have collated a list of the relevant documents in Annex D of this response.
