Information requested
1. A copy of the terms of reference for the Employment Injury Assistance Steering Group.
2. A list of the invited members of the Employment Injury Assistance Steering Group.
3. Copies of any other correspondence held by the Scottish Government relating to the planning of, rationale for, and briefing for government ministers and staff in advance of or during the Employment Injury Assistance Steering Group meetings.

I enclose a copy of some of the information you requested.
Some of the information you have requested is available from the Scottish Parliament Website, specifically Employment Injury Assistance EIA | Scottish Parliament Website. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section 27(1) (Information intended for future publication), section 30(b)(i) (Free and frank provision of advice), section 30(c) (Otherwise prejudice effective conduct of public affairs), section 38(1)(b) (Personal data relating to third party) of FOISA applies to that information. The reasons why these exemptions apply are explained below/in the Annex to this letter.

An exemption applies
An exemption under section 27(1) – Information intended for future publication of FOISA applies to the information you have requested. The Scottish Government intends to publish the information within the next 12 weeks.
This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
Part 2 of Request – A list of the invited members of the Employment Injury Assistance Steering Group
The Scottish Government does not hold the information requested
The Scottish Government does not have the information you have asked for because membership to the Group has not yet been finalised and invitations have not yet been issued.
As such, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
