Circularity Scotland tender process: EIR release

Information requested

I would be grateful to receive a copy of all communication between the Scottish Government and Circularity Scotland regarding the tender process carried out which ultimately led to Biffa being awarded the contract. The period I would like this EIR to cover is 1st January 2022 and 31st October 2023.

I have included copies of the information you have requested in Annex B.

On reviewing materials within the scope of your request, an exception has been applied in line with the EIRs. The exception applied can be found in Annex A.

I would also note that Biffa were contracted by Circularity Scotland Ltd to provide logistics for Scotland’s Deposit Return Scheme. In appointing Biffa, an extensive tender process was carried out by Circularity Scotland over a 12 month period. This was a commercial arrangement between two private businesses and as such it would not be appropriate for Scottish Government Ministers or officials to be involved in said process.
