Information request and response under the Freedom of Information (Scotland) Act 2002


Information requested

  1. During the Scottish Parliament's Convener's Group meeting on September 27, 2023, Humza Yousaf said that certain FOIs had been brought to cabinet to discuss. Which FOIs were they, why were they brought to cabinet, and what was the resulting decision?
  2. Please also provide the responses to the FOIs that were brought to Cabinet, and confirm whether they had ministerial and/or special adviser consultation and/or sign off prior to initial release.

Response

The answer to your first question is that on 6, 13, 20 and 26 June 2023, Cabinet discussed the process around ensuring that it met its statutory duties under the Freedom of Information legislation. I can confirm that no individual Freedom of Information cases were discussed at Cabinet.

In response to your second question, while our aim is to provide information whenever possible, in this instance I confirm under the terms of Section 17(1) of FOISA that the Scottish Government does not hold the information requested.
