I have been asked to look at your request afresh, to decide whether the original response should be confirmed, with or without modifications, as appropriate, or that a fresh decision should be substituted. I can confirm that I was not involved in the handling or decision-making around the original response.
In conducting my review I have re-examined the information held on our electronic information management systems and having done so, I have identified some information falling within the scope of your request. I have therefore concluded that the original decision should be confirmed, with modifications.
I can confirm that a site visit took place at Barmuckity Farm on the 17th July 2018 and lunch was then provided at Springfield Properties. The information provided is the ministerial briefing pack (1) which is enclosed. The briefing pack was prepared in advance of 17 July 2018 and provides details of thevenue and includes (2) agenda of the meeting (running order of the site visit) ; and (3) a list of attendees. An exception under regulation 11(2) of the EIRs (personal information) applies to a small amount of the information within the briefing pack because it is personal data of a third party an disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not
subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception. Annex B is also redacted in full as this was supplementary guidance for the minister on a current top issue and does not fall within the scope of your request.
However, I have concluded that we were entitled to respond to your request under regulation 10(4)(a) (information not held) of the EIRs in part because the Scottish Government does not hold some of the information you have requested. .As noted above, I have re-examined the information held on our electronic information management systems and having done so, I am satisfied that the Scottish Government does not have (4)minutes or notes from any meeting; and (5) post meeting action points.
